Hi, I'm new on here.
What is classed as ASB?
I have a problem with skateboarders and kids on in line scooters. Is this ASB?????
There is an alleyway at the side of my house. Which is a cut through, but is very rarely used.
However, it is used on a daily basis by these kids, 'jumping' down the brick steps.
The noise is unbearable!
I am disabled and it is affecting my health as I am 95% bed bound.
They are asked to go away and then back they come again!
They also, make my dogs get very agitated and bark. Which is very unfair.
I don't know who they are, or if they even live on the estate.
Myself and my neighbour have complained to Hydemartlet.
I'd really like them to install some posts in the alleyway, which would stop them doing it.
Simple solution! But what are the chances of them doing that??
I'm still waiting to hear back from them, after sending 2 emails.
The prospect of keeping a diary for months, seems pointless!

I've been experiencing anti socail behaviour from my neighbours for over a year. We have decided to move because my our child does not feel safe to play outside but we carried out major expence on repiring the garden last summer. would hyde be prepared to pay us back for this expence becasue we have decided to move?

Hi Gemma,

If you look on your local authority's website, they should have some information about their local procedures for reporting anti-social behaviour. I empathise with you having a young baby and the sleep deprivation that comes with that alone, never mind the neighbours.

DIY at 'unreasonable' hours is classed as "statutory noise pollution" so if it can be proved, the neighbour's landlord and local authority have duties to control this. The term "unreasonable" is unhelpful but I think with the times you have stated, it's a good case. (By the way, if the neighbour tries a counter-attack like complaining about a crying baby, the noise from a crying baby, although annoying, is not a statutory nuisance.)

You need to note down everything so far, with dates and times. In particular, note down the times you have approached the neighbour. Since this doesn't seem to work, ask for assistance from the landlord and Council's environmental health department, using your diary notes to support your case. Also investigate if there is a Mediation service available in your area - some Councils insist on using this first anyway. If the neighbour refuses to participate (it's voluntary), it would add weight to your case that they are being unreasonable.

If there is any pattern to the noise, the Council might be able to install a recorder in your home to capture it.

Nicky, Paul, Gemma: I'm sorry to hear that you have been experienciencing these problems.
But I'm glad that this forum gives you more opportunities to bring it to attention, and exchange advice with other residents and help each other out.

I would suggest if you have kept a diary, keep a copy before you send it off anywhere, just in case it gets lost.

KEPT A DIARY FOR 4MNTHS SENT TO HYDE IN MAIDSTONE AS OUR EVIDENCE . ASB TENANT WAS MEANT TO BE GOING TO COURT IN NYR 2010 . NOTHING CAME OF IT . YET I GET VICTAMISED BULLIED AND MESSED ABOUT BY THE NEW H/O AND SCRUTINISED FOR HAVING TO GET A DOG FOR MY OWN PEACE OF MIND AND SAFETY . HE IS AN APARTMENT DOG AND HAS NOT BEEN A NUSIENCE NOR CAUSED DAMAGE TO PROPERTY UNLIKE THE TENANT IN QUESTION ! FUNNY HOW THE PROBLEM ONE GETS TURNED ROUND ON ME ILL TAKE THIS SO FAR IF I GET NO SUPPORT FROM HYDE AND I MEAN ILL TAKE IT TO THE TOP . MY LIFE HAS BEEN RUIEND BY AN 18YR OLD BUM AND A BULLYING HARRASSING H/O

just a little suggestion keep a diary on the asb so when it comes to filling out log sheets you already have them in advance it should help staff speed up their reactions

Hi gemma, really feel for you. I would start by noting the time and duration of the noise and as Larry said contact your housing officer. They will be able to point you in the right direction and help you.

Have you spoken to your Housing Officer? Its not reasonable to be banging late at night especially if you have a young baby and you have already spoken to them and it has continued. I would contact your Housing Officer who can speak to your neighbour tactfully and hopefully it will stop. If not the Housing Officer can get into the flat as some DIY works can be seen as breaking the terms of a tenancy.

What is bearable before it becomes ASB? What is the reasonable time somesome should stop drilling and banging at night? When do you report it? after you have asked them twice to stop doing it before 9 especially you have a baby that is trying to sleep and as new parents its hard enough to get sleep as it is without constant DIY going on next door. Is it reasonable to be banging at 11.50 pm at night or even at 9.15 pm
